What Is an Immigration Bond?

Immigration and Customs Enforcement (ICE) determines an amount of money that the detained individual must pay to be released from detention. This is called an immigration bond. In exchange, the bonded individual agrees to appear in court. If the bonded individual attends all required legal proceedings, the bond money will be returned. However, if they flee or fail to attend, they forfeit the bond money.

Am I Eligible for Bond?

Most individuals are eligible for bond. However, some are subject to mandatory detention if they have committed certain serious crimes, and will not be eligible for release.

If you have been convicted of any of the following crimes, you will not be eligible for an immigration bond:

  • Aggravated felony

  • Crimes of moral turpitude, which are defined loosely, but typically refer to murder, rape, spousal or child abuse, kidnapping, robbery, and other similar crimes

  • Suspected of terrorism

  • Possession of controlled substances (excepting 30 grams or less of marijuana)
