Do I Qualify for an L1A or L1B Visa?
If this description fits your job, you may be eligible to apply for the L1A visa:
- you are the manager of some function of the organization;
- you are a supervisor to other employees or manage necessary operations within the organization;
- you have the authority to hire, fire, and recommend promotions; and
- you have a management or leadership role that involves making decisions for the company with little supervision.
You are eligible for the L1B visa if you have special or unique knowledge regarding any of the essential aspects of the company’s work. This could include expertise in how the company works operationally, or it could be special knowledge regarding some service, product, technology, equipment, etc. This visa is reserved for “key” employees who are considered absolutely vital. However, being a high-performing employee is not enough, even if you are more skilled than the average worker.
In order to qualify for this visa, you must demonstrate that no other person could be trained to do your job without causing great economic inconvenience to the organization. Examples include: employees who have specialized knowledge of the company’s proprietary software or products; or individuals involved in specialized research for the company.
