If you are living and working abroad and your company is transferring you to a U.S. location, you will need to determine your eligibility to obtain an L1A or L1B visa. The L1A is for managers and executives, while the L1B is for employees and professionals who have specialized knowledge necessary for the company’s existing operations in the U.S. Qualifying employees can also help establish a new U.S. location for their overseas employer.

Do I Qualify for an L1A or L1B Visa?

You may be eligible to apply for the L1A visa if:

  • You manage an essential function of the organization;

  • You supervise other professional employees or manage necessary operations within the organization;

  • You have the authority to hire, fire, and recommend promotions; and

  • You have a management or leadership role that involves making decisions for the company with little supervision.

You are eligible for the L1B visa if you have unique knowledge regarding any of the essential aspects of the company’s work. This could include expertise in the company’s operations, or it could be special knowledge regarding some service, product, technology, equipment, etc. This visa is reserved for “specialized” employees who are considered absolutely vital.

To qualify for this visa, you must demonstrate that no other person could be trained to do your job without causing great economic inconvenience to the organization. Examples include: employees who have specialized knowledge of the company’s proprietary software or products; or individuals involved in specialized research for the company.

An L1-A visa grants up to seven years of work eligibility in the U.S. and the L1B grants five years. If you were initially granted the L1B visa for possessing special knowledge, but are now a company manager, you may apply to switch your status.
